Federal Court

The United States District Courts (Federal Courts) hear cases involving federal law, the constitution, civil rights as well as employment discrimination.  Victims of civil rights violations and employment discrimination may present their cases to juries in federal court.  For some employment discrimination claims, a litigant must first file a charge with the Equal Employment Opportunity Commission (EEOC) or the Illinois Department of Human Rights, (IDHR) request and obtain a right-to-sue letter before filing a lawsuit in federal court.  In some instances, claims of race discrimination and/or harassment may be heard in federal court regardless of whether a charge is filed.
